230Amendments to Dairy Industry Restructuring Act 2001
This section amends the Dairy Industry Restructuring Act 2001.
Section 29C is amended by omitting 29L and substituting 29H.
Section 29I(1) is amended by—
- omitting A District Court Judge, Community Magistrate, Justice of the Peace, or Registrar may issue a search warrant in the form set out in Schedule 5D and substituting An issuing officer (within the meaning of section 3 of the Search and Surveillance Act 2012) may issue a search warrant; and
- omitting in writing made on oath and substituting made in the manner provided in subpart 3 of Part 4 of the Search and Surveillance Act 2012.
Section 29I is amended by repealing subsections (2) and (3) and substituting the following subsections:
Subject to section 29L and subsection (3), the provisions of Part 4 of the Search and Surveillance Act 2012 apply.
Despite subsection (2), sections 118 and 119 of the Search and Surveillance Act 2012 apply only in respect of a warrant issued to a named constable or to every constable.
Sections 29J and 29K are repealed.
Section 29L is amended by—
- omitting Section 199 of the Summary Proceedings Act 1957 and substituting Subpart 6 of Part 4 of the Search and Surveillance Act 2012; and
- repealing paragraphs (a) to (c).
Section 145(j) is amended by omitting sections 98B to 98G and substituting section 98G.
Schedule 5D is repealed.
