254Amendments to Gambling Act 2003

  1. This section amends the Gambling Act 2003.

  2. Section 335 is amended by repealing subsection (3) and substituting the following subsection:

  3. The provisions of Part 4 of the Search and Surveillance Act 2012 (except subpart 3) apply.

  4. Section 335(5) is repealed.

  5. Section 336 is amended by repealing subsection (3) and substituting the following subsection:

  6. The provisions of Part 4 of the Search and Surveillance Act 2012 (except subpart 3) apply.

  8. Section 337 is repealed.

  9. Section 340 is amended by repealing subsection (2) and substituting the following subsection:

  10. An application must be made in the manner provided in subpart 3 of Part 4 of the Search and Surveillance Act 2012 to an issuing officer (within the meaning of section 3 of that Act).

  11. Section 340(3) is amended by omitting The Judge, Justice, Magistrate, or Registrar and substituting The issuing officer.

  12. Section 340 is amended by inserting the following subsections after subsection (3):

  13. Subject to subsection (3B), the provisions of Part 4 of the Search and Surveillance Act 2012 apply.

  14. Despite subsection (3A), sections 118 and 119 of the Search and Surveillance Act 2012 apply only in respect of a warrant issued to a named constable or every constable.

  15. Section 340(4) is amended by omitting sections 341 and and substituting section.

  16. Sections 341 to 343, and 345 are repealed.

  17. Section 369(d) is amended by omitting 331, and a search warrant under section 341 and substituting 331.
