291Amendment to Petroleum Demand Restraint Act 1981

  1. This section amends the Petroleum Demand Restraint Act 1981.

  2. Section 17 is amended by repealing subsection (4) and substituting the following subsection:

  3. Petroleum demand restraint regulations may provide for the following matters in respect of suspected offences against this Act or against any petroleum demand restraint regulations, regardless of whether any such suspected offences (relevant offences) are imprisonable or not:

  4. authorising persons, designated by the Minister in writing for the purpose (designated persons), to search places, vehicles, or other things under a warrant in relation to any relevant offence:
    1. providing for the application of provisions of the Search and Surveillance Act 2012 to the powers conferred under paragraph (a) and, in particular and without limitation,—
      1. deeming all designated persons, or any designated persons of a specified class, to be enforcement officers for the purposes of that Act:
        1. authorising all designated persons, or any designated persons of a specified class, to apply for a warrant under section 6 of that Act as if such designated persons were constables.
