149: Disposal of things seized or produced

When something is taken from you under a court order or seized by the police, it must be handled in a certain way. You can find out how this is done by looking at this part of the law. However, there are some exceptions, such as if the thing was taken from someone in police custody, or if it is related to privilege and confidentiality, which is explained in section 13 and subpart 5 of this Part.

If cash is seized under section 123B of this Act, this part of the law does not apply. The police or the court must follow the rules about what happens to things that are seized or produced.

This law is also subject to other laws, which means that sometimes other rules might apply instead.

149Disposal of things seized or produced

  1. If any thing is produced under a production order or is seized under a search warrant or under a search power conferred by this Act or an enactment specified in column 2 of the Schedule to which this section applies, it must be dealt with in accordance with this subpart.

  2. However, this subpart is subject to—

  3. section 13 (which deals with property taken from people locked up in Police custody); and
    1. subpart 5 of this Part (which relates to privilege and confidentiality); and
      1. any other enactment.
        1. This subpart does not apply to cash seized under section 123B of this Act.
