256Amendments to Health Practitioners Competence Assurance Act 2003

  1. This section amends the Health Practitioners Competence Assurance Act 2003.

  2. Section 10(1) is amended by omitting section 198 of the Summary Proceedings Act 1957 and substituting section 6 of the Search and Surveillance Act 2012.

  3. Section 10 is amended by inserting the following subsection after subsection (1):

  4. A person who is authorised in writing by the Director-General of Health to apply for search warrants in relation to the offences referred to in subsection (1) may apply for such a warrant under section 6 of the Search and Surveillance Act 2012 as if that person were a constable.

  5. Section 10 is amended by repealing subsection (2) and substituting the following subsection:

  6. The provisions of Part 4 of the Search and Surveillance Act 2012 (except sections 118 and 119) apply.

  7. Section 10(3) is amended by—

  8. omitting section 199 of the Summary Proceedings Act 1957 and substituting subpart 6 of Part 4 of the Search and Surveillance Act 2012; and
    1. omitting from paragraph (a) section 199 of that Act and substituting subpart 6 of Part 4 of that Act.
