When you are looking at the law about searching and surveillance, you need to know about Part 4 of the Search and Surveillance Act 2012. This part of the law applies to search warrants that are asked for or given under the Criminal Proceeds (Recovery) Act 2009, except for one part called subpart 6. When evidence is taken under certain sections of the law, the rules in subpart 6 of Part 4 of the Search and Surveillance Act 2012 do apply. These sections are 101(2)(a), and 102(2)(b) and (c). This means that if evidence is seized under these sections, the rules in subpart 6 are used.
