285Amendments to National Parks Act 1980

  1. This section amends the National Parks Act 1980.

  2. Section 61(2) is repealed.

  3. Section 61(3) is amended by—

  4. omitting If and substituting If, in any case to which paragraph (a) or (b) applies,; and
    1. omitting if in proceedings and substituting in proceedings; and
      1. omitting then, and substituting then, despite subpart 6 of Part 4 of the Search and Surveillance Act 2012,; and
        1. repealing paragraph (c).

          1. Section 61(6) is amended by omitting , and shall be retained by the Director-General and dealt with under subsection (7) or subsection (8) of this section.

          2. Section 61 is amended by repealing subsections (7) and (8) and substituting the following subsection:

          3. Subject to subsection (3), the provisions of Part 4 of the Search and Surveillance Act 2012 (except subpart 3) apply.

          4. Section 65 is amended by repealing subsection (2) and substituting the following subsection:

          5. The provisions of Part 4 of the Search and Surveillance Act 2012 (except subpart 3 and sections 118 and 119) apply.

          6. Section 66 is amended by repealing subsections (2) and (3) and substituting the following subsection:
