This Part of the law applies to all fish stocks that the Minister has made subject to the quota management system. You can find out how the Minister does this by looking at section 18. The Minister can also make a declaration about this under other laws. This Part does not apply to fishing that is allowed by a foreign fishing licence issued under Part 5. If a type of fish or seaweed was already subject to certain rules before this Part came into effect, it is now considered to be part of the quota management system, as if the Minister had declared it under section 18.

Application of this Part

17Application of Part generally

  1. This Part applies to every stock made subject to the quota management system by—

  2. a declaration by the Minister by notice under section 18 (whether made before or after the commencement of section 5 of the Fisheries Amendment Act (No 3) 2004); or
    1. any provision of this Act or any other Act.

      1. This Part does not apply to fishing authorised by a foreign fishing licence issued under Part 5.

      2. For the purposes of subsection (1) and this Part, every species or class of fish, aquatic life or seaweed that was, immediately before the commencement of this Part, subject to Part 2A of the Fisheries Act 1983 is deemed to have been declared by the Minister by notice under section 18 to be subject to the quota management system.
