High seas fishery inspectors
113WPersons on New Zealand ships to co-operate with foreign high seas inspectors
The master of a ship must co-operate with a foreign high seas inspector appointed by a participating State that is a member of or participant in a notified global, regional, or subregional fisheries organisation or arrangement where—
- the ship—
- is registered under the Ship Registration Act 1992; or
- flies the New Zealand flag; and
- is registered under the Ship Registration Act 1992; or
- the ship is on the high seas in an area covered by that organisation or arrangement
. -
The master of a ship must co-operate with a foreign high seas inspector appointed in relation to an area covered by a notified global, regional, or subregional fisheries organisation or arrangement where—
- the ship—
- is registered under the Ship Registration Act 1992; or
- flies the New Zealand flag; and
- is registered under the Ship Registration Act 1992; or
- the ship is on the high seas in an area covered by the organisation or arrangement; and
- New Zealand is a member of the organisation or arrangement; and
- the organisation or arrangement has established procedures for boarding and inspecting vessels as provided in Article 21.2 of the Fish Stocks Agreement.
Every person on a ship to which subsection (1) or subsection (2) applies must—
- accept and facilitate prompt and safe boarding of the ship by the foreign high seas inspector; and
- co-operate with and assist in the inspection of the vessel; and
- not obstruct, intimidate, or interfere with the foreign high seas inspector in the performance of his or her duties; and
- allow the foreign high seas inspector to communicate with the authorities of New Zealand and of the State that appointed the inspector; and
- provide reasonable facilities to the foreign high seas inspector, including food and accommodation (where appropriate); and
- facilitate safe disembarkation from the ship by the foreign high seas inspector.
Every person who contravenes subsection (1), subsection (2), or subsection (3) commits an offence and is liable to the penalty set out in section 252(3).
