Registration procedure

160Provisions relating to defective applications for registration

  1. If—

  2. any document relating to a transaction lodged for registration; or
    1. any document presented for registration together with any other documents—
      1. is found not to be in order for the purposes of registration, the chief executive may return that document or those other documents to the person by whom they were lodged or, if that person is not available, to such other person as may, in the opinion of the chief executive, be entitled to receive them.

      2. Before returning any documents in accordance with subsection (1),—

      3. the chief executive shall make a copy of every document returned; and
        1. shall file the copy in the chief executive's office.
          1. If any documents are returned as provided in subsection (1), those documents shall be deemed not to have been presented for registration but the fee (if any) paid to the chief executive in respect of them shall be forfeit.
