At the start of each fishing year, the chief executive allocates your annual catch entitlement. This is for any quota management stock generated under section 66. You get this allocation on the first day of the fishing year. If the total allowable commercial catch for Foveaux Strait dredge oysters increases, the chief executive recalculates your entitlement. They use the new total allowable commercial catch to work out your new entitlement. This is done under section 66. The chief executive makes sure you do not get part of a kilogramme of annual catch entitlement. They round your entitlement up or down to avoid this. Your annual catch entitlement starts on the date it is allocated. The chief executive tells you how much annual catch entitlement you get. They also tell the Registrar of Annual Catch Entitlement how much you get. This happens as soon as possible after your entitlement is allocated.

67Allocation of annual catch entitlement

  1. On the first day of each fishing year, the chief executive must allocate to each quota owner the person's annual catch entitlement for any quota management stock that has been generated under section 66.

  4. If between the beginning of a fishing year and the beginning of the Foveaux Strait dredge oyster season in that year there is an increase in the total allowable commercial catch for Foveaux Strait dredge oysters,—

  5. the chief executive must calculate the amount of annual catch entitlement that each person would have received under subsection (1) if the altered total allowable commercial catch had been in effect at the beginning of the fishing year, and an annual catch entitlement had been generated under section 66 accordingly; and
    1. the chief executive must, on or before the first day of the Foveaux Strait dredge oyster season, allocate to each person who receives an amount of annual catch entitlement under subsection (1) for Foveaux Strait dredge oysters a further amount of annual catch entitlement for that stock calculated in accordance with the following formula:
      1. Repealed

      3. Any annual catch entitlement calculated under this section shall be rounded up or rounded down by the chief executive to ensure that no quota owner holds part of a kilogramme of annual catch entitlement as a result of an allocation.

      4. Any annual catch entitlement allocated under this section shall have effect for all purposes of this Act on and from the date of allocation.

      5. The chief executive shall, as soon as practicable after allocating any annual catch entitlement in accordance with this section, notify every quota owner of the amount of annual catch entitlement allocated to that quota owner under this section.

      6. The chief executive shall, as soon as practicable after allocating any annual catch entitlement in accordance with this section, notify the relevant Registrar of Annual Catch Entitlement of the amount of annual catch entitlement allocated to each quota owner.
