236Proceedings for offences
Any offence against this Act shall be deemed to have been committed in New Zealand.
Despite anything to the contrary in section 25 of the Criminal Procedure Act 2011, the limitation period in respect of an offence against this Act—
- ends on the date that is 12 months after the date on which the offence was committed if the offence is one for which the maximum fine does not exceed $10,000:
- ends on the date that is 2 years after the date on which the offence was committed if the offence is one for which the maximum fine exceeds $10,000.
No prosecution for an offence against this Act may be commenced except by—
- the chief executive; or
- the chief executive of the department for the time being responsible for the administration of the Conservation Act 1987; or
- any fishery officer; or
- the Fish and Game Council in any district in which an offence has been committed or an offender is found.
