113CNotification and certification by Secretary of Foreign Affairs and Trade
The Secretary of Foreign Affairs and Trade may from time to time, by notice in the Gazette, give notice of a global, regional, or subregional fisheries organisation or arrangement.
A notice given under subsection (1) must specify where a copy of the constitution of the organisation or a copy of the arrangement, as the case may be, may be obtained.
The Secretary of Foreign Affairs and Trade may sign a certificate stating that a specified State is or is not—
- a State that is a party to the Fish Stocks Agreement; or
- a State that is a party to the FAO Compliance Agreement; or
- a State that is a participant in, is a member of, or has accepted the obligations of, a global, regional, or sub-regional fisheries organisation or arrangement; or
- a State that is a signatory to the Fish Stocks Agreement
, and has legislative and administrative mechanisms to control its vessels on the high seas in accordance with that agreement. A certificate referred to in subsection (3) is, for all purposes, conclusive evidence of its contents unless the contrary is proved by the production of a more recent certificate issued under that subsection.
