113CNotification and certification by Secretary of Foreign Affairs and Trade

  1. The Secretary of Foreign Affairs and Trade may from time to time, by notice in the Gazette, give notice of a global, regional, or subregional fisheries organisation or arrangement.

  2. A notice given under subsection (1) must specify where a copy of the constitution of the organisation or a copy of the arrangement, as the case may be, may be obtained.

  3. The Secretary of Foreign Affairs and Trade may sign a certificate stating that a specified State is or is not—

  4. a State that is a party to the Fish Stocks Agreement; or
    1. a State that is a party to the FAO Compliance Agreement; or
      1. a State that is a participant in, is a member of, or has accepted the obligations of, a global, regional, or sub-regional fisheries organisation or arrangement; or
        1. a State that is a signatory to the Fish Stocks Agreement, and has legislative and administrative mechanisms to control its vessels on the high seas in accordance with that agreement.
          1. A certificate referred to in subsection (3) is, for all purposes, conclusive evidence of its contents unless the contrary is proved by the production of a more recent certificate issued under that subsection.
