113ZEConsent of Attorney-General required for certain proceedings

  1. This section applies to proceedings for offences under the following sections:

  2. section 113DAAA (illegal fishing or transportation in the fisheries jurisdiction of a foreign country):
    1. section 113E (unlawful use of foreign vessel on high seas by New Zealand national).
      1. Despite anything in any other enactment, those proceedings may not be instituted in any court except with the consent of the Attorney-General and on the Attorney-General's certificate that it is expedient that the proceedings should be instituted.
