The Minister calculates demerit points against organisations at the end of each year. You will know how many points you have when the Minister tells you. As soon as practicable after the end of each financial year, the Minister must calculate the total number of demerit points recorded under section 296S(2) against an approved service delivery organisation during that year.
The Minister must advise the organisation as soon as reasonably practicable of the amount of civil penalty payable in respect of the total number of demerit points.
The amount of civil penalty payable in respect of specified failures is prescribed in regulations made under section 296ZI.
As soon as practicable after the end of each financial year, the Minister must cancel the demerit points recorded against an approved service delivery organisation in respect of that financial year, but the applicable civil penalty is payable despite the cancellation of those demerit points.
