If you admit to doing something wrong under the Fisheries Act, the chief executive might give you a fine. The fine is not more than half of the maximum fine if the wrong thing was against a condition of an international fishing permit. It is not more than one-third of the maximum fine in other cases. Before giving you the fine, the chief executive must think about what you say under section 113ZB. The chief executive must give you a written notice with the fine details. 113ZCAmount of administrative penalty

  1. If a person admits an offence under section 113ZB, the chief executive may impose on the person a monetary penalty not exceeding—

  2. one-half of the maximum monetary penalty, if the offence is against section 113J(2) (contravening a condition of an international fishing permit):
    1. one-third of the maximum monetary penalty, in any other case.
      1. Before imposing the penalty, the chief executive must take into account any submissions made by the person under section 113ZB.

      2. If the chief executive imposes a penalty on a person under this section in respect of an offence, the chief executive must cause a notice in writing, in the approved form, of the particulars of the penalty to be served on the person.

      3. A person on whom a penalty is imposed under this section must pay the amount of the penalty to the Crown within 28 days after the notice of the penalty is served on the person in accordance with subsection (2).

      4. Despite subsection (3), a penalty that has been imposed under this section is recoverable by the Crown, from the person on whom it has been imposed, in the same manner as a fine is recoverable on conviction for an offence.

      5. Despite the provisions of this Act, or any other enactment, where a person admits an offence under section 113ZB, no charging document may be filed against that person in respect of the offence.

      6. In this section, maximum monetary penalty means the maximum monetary penalty to which the person would be liable if they were convicted of the offence by a court.
