If you are the master of a foreign fishing vessel, you must tell the chief executive at least 72 hours before you bring your vessel into New Zealand's internal waters or a port. 113ZDVisits by foreign ships

  1. The master of a fishing vessel or fish carrier that is not a New Zealand ship, a New Zealand fishing vessel, or a registered fish carrier, who intends to bring the vessel into the internal waters or a port of New Zealand, must give the chief executive at least 72 hours' notice, in the approved manner, of his or her intention to do so.

  2. If the chief executive is satisfied that a vessel has undermined the effectiveness of international conservation and management measures, the chief executive may, by notice to the master of a vessel to which subsection (1) applies, direct the vessel—

  3. not to enter the internal waters or a port of New Zealand; or
    1. if it has entered the internal waters or a port of New Zealand, to leave those waters or that port.
      1. If the Minister is satisfied on reasonable grounds that it is necessary for the purpose of the conservation and management of fish, aquatic life, or seaweed, the Minister may, by notice, direct any class or classes of fishing vessel or fish carrier not to enter the internal waters or a port of New Zealand.

      2. The master of a vessel to which a notice under subsection (2) or subsection (3) applies, who brings the vessel into the internal waters or a port of New Zealand knowing that the notice applies to the vessel, commits an offence and is liable to the penalty set out in section 252(5).

      3. This section does not prevent a vessel from entering or remaining in the internal waters or a port of New Zealand in the case of force majeure, subject to any conditions set by the chief executive.

      4. A notice under subsection (3) is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
