55Determination or order not to affect quota allocated to Te Ohu Kai Moana Trustee Limited

  1. None of the following, namely, any—

  2. determination of the Catch History Review Committee; or
    1. order of any court, where the order relates to an application for a declaration concerning whether any person is, or is not, an overseas person; or
      1. transfer of quota by the chief executive for the purposes of giving effect to any such determination or order—
          1. shall affect any quota allocated to Te Ohu Kai Moana Trustee Limited under section 44 (or part of such quota) if Te Ohu Kai Moana Trustee Limited has continuously owned such quota from the date of allocation to the date of the transfer of quota by the chief executive.
