You cannot take fish, aquatic life, or seaweed in New Zealand's exclusive economic zone using a foreign fishing vessel unless you have a licence issued under section 83 or the Minister's written consent. You must follow the conditions of the licence or consent. If you do not, you may commit an offence. You can get the Minister's consent if you are using the vessel for fisheries research, experimentation, or recreation. The Minister can give consent with or without conditions, such as paying fees. 84Licensing offences

  1. No person may take any fish, aquatic life, or seaweed within the exclusive economic zone using a foreign fishing vessel except—

  2. under the authority of—
    1. a licence issued under section 83; or
      1. if the vessel is used for the purposes of fisheries research or experimentation (including gear and equipment trials) or recreation, the prior written consent of the Minister; and
      2. in accordance with any conditions of that licence or consent.
        1. Consent under subsection (1)(a)(ii) may be given unconditionally or upon or subject to such conditions, including the payment of fees, as the Minister thinks fit.

        2. Every person commits an offence and is liable to the penalty set out in section 252(2) who contravenes subsection (1)(a).

        3. Every person commits an offence and is liable to the penalty set out in section 252(3) who contravenes subsection (1)(b).
