"Rules for flying and aviation in New Zealand and overseas"
This act applies to everyone and everything related to aviation in New Zealand. This includes people, aircraft, airports, air services, and other aviation-related services. It also covers New Zealand-registered aircraft when they're flying outside of New Zealand, and people with New Zealand aviation documents when they're in other countries.
The Minister can make agreements with other countries to change who's responsible for aircraft. They might give control of a New Zealand-registered aircraft to another country if a foreign company is using it. Or, they might take control of a foreign-registered aircraft if a New Zealand company is using it. The Minister can also make exceptions to the rules in some cases.
When New Zealand aircraft fly over international waters, they must follow the international Rules of the Air. If you have a New Zealand aviation document and do something wrong while in another country, you can still be punished as if you did it in New Zealand. However, you don't have to break another country's laws to follow this act.
This act doesn't affect the special rights of foreign military aircraft or their crew. The Minister can make exceptions to the act for specific people or groups, but these exceptions must be officially published unless they're just for named individuals.
The Parliamentary Counsel Office has made editorial and format changes to this version using the powers under subpart 2 of Part 3 of the Legislation Act 2019.
