In this part of the law, you’ll learn about some important words and what they mean for international air services.

When we talk about “capacity” for a scheduled international air service, we mean how many seats are available each week for passengers, or how much space is available for cargo. This is measured for each route the planes fly.

A “foreign international airline” is an air transport company from a country that isn’t New Zealand. It offers or runs regular international flights, or plans to do so.

A “licensee” is someone who has been given permission (a licence) to operate under this part of the law.

A “New Zealand international airline” is a New Zealand air transport company that offers or runs regular international flights, or plans to do so.

A “scheduled international air service” is a series of regular flights that carry passengers, cargo, or mail between New Zealand and other countries. These flights happen often enough to be considered a regular service, and anyone can book them. For New Zealand airlines, this also includes something called a “seventh freedom service”.

A “seventh freedom service” is a special type of flight service. It’s when a New Zealand airline flies between two other countries, not including New Zealand. To do this, New Zealand must have an agreement with both countries, and the airline must follow the rules set out in those agreements.

87AInterpretation

  1. In this Part,—

    capacity, in relation to a scheduled international air service, means—

    1. with respect to the transport of passengers, the number of seats provided per week on each route followed (expressed either as a number of seats or in terms of aircraft equivalents); and
      1. with respect to the transport of cargo, the amount of cargo space provided per week on each route followed (expressed in terms of cargo aircraft equivalents)

        foreign international airline means an air transport enterprise of a country or territory other than New Zealand that is offering or operating a scheduled international air service or intends to offer or operate such a service

          licensee means the holder for the time being of a licence issued under this Part

            New Zealand international airline means a New Zealand air transport enterprise that is offering or operating a scheduled international air service or intends to offer or operate such a service

              scheduled international air service means a series of flights performed by aircraft for the transport of passengers, cargo, or mail between New Zealand and 1 or more points in any other country or territory, where the flights are so regular or frequent as to constitute a systematic service, whether or not in accordance with a published timetable, and which are operated in such a manner that each flight is open to use by members of the public; and, in relation to a New Zealand international airline, includes a seventh freedom service

                seventh freedom service means a series of flights between 1 or more points in 1 country or territory other than New Zealand and 1 or more points in another country or territory other than New Zealand, if—

                1. the airline is designated by New Zealand under the air services agreement (or similar arrangement) between New Zealand and each country or territory in which the service is being performed; and
                  1. the service is performed according to the traffic rights allocated to the airline under those agreements (or arrangements); and
                    1. the service is a scheduled service.
