43A: Operating aircraft in careless manner

"You must fly an aircraft carefully or you might get in trouble"

If you operate an aircraft carelessly, you are breaking the law. This is called an offence.

If you are found guilty of operating an aircraft carelessly, you might have to pay a fine. If you are an individual person, you could be fined up to $7,000. If you are a company, you could be fined up to $35,000.

There might be other rules about operating aircraft. This law doesn't replace those rules - it's in addition to them.

43AOperating aircraft in careless manner

  1. Every person commits an offence who operates any aircraft in a careless manner.

  2. Every person who commits an offence against subsection (1) is liable on conviction,—

  3. in the case of an individual, to a fine not exceeding $7,000; or
    1. in the case of a body corporate, to a fine not exceeding $35,000.
      1. The provisions of this section shall be in addition to and not in derogation of any regulations or rules made under this Act.
