When you apply for a new aviation document or want to renew an existing one, the Director of Civil Aviation will look at your application. They will try to approve it quickly if they are satisfied with a few things.

The Director needs to make sure that everything related to your document meets the required standards. They also check if you, and anyone else who might use the privileges of the document, have the right qualifications and experience. Sometimes, they might accept qualifications from other countries.

The Director will also make sure that you and anyone else involved are fit and proper persons to hold the document. This means you need to be responsible and trustworthy. You also need to meet any other requirements that are set out.

If you’re applying for a special kind of document called a New Zealand AOC with ANZA privileges, there are some extra things you need to do. The Director will check if you meet these additional requirements.

The Director will only approve your application if it’s safe for aviation. Even after you get your document, you and anyone using its privileges must continue to be fit and proper persons.

If the Director doesn’t approve your application, you can appeal this decision to the District Court.

9Grant or renewal of aviation document

  1. After considering any application for the grant or renewal of an aviation document, the Director shall, as soon as is practicable, grant the application if he or she is satisfied that—

  2. all things in respect of which the document is sought meet the relevant prescribed requirements; and
    1. the applicant and any person who is to have or is likely to have control over the exercise of the privileges under the document—
      1. either holds the relevant prescribed qualifications and experience or holds such foreign qualifications as are acceptable to the Director under subsection (2); and
        1. is a fit and proper person to have such control or hold the document; and
          1. meets all other relevant prescribed requirements; and
          2. in the case of a New Zealand AOC with ANZA privileges,—
            1. the requirements in section 11G(2) are met; and
              1. the applicant meets or will meet the conditions in section 11G(4); and
              2. it is not contrary to the interests of aviation safety for the document to be granted or renewed.
                1. For the purpose of granting or renewing an aviation document, the Director may, subject to any provisions in the rules, accept such foreign qualifications or recognise such foreign certifications as he or she considers appropriate in each case.

                2. It shall be a condition of every current aviation document that the holder and any person who has or is likely to have control over the exercise of the privileges under the document continue to satisfy the fit and proper person test specified in subsection (1)(b)(ii).

                3. Where the Director declines to grant an application for the grant or renewal of an aviation document under this section, the applicant may appeal against that decision to the District Court under section 66.
