46B: Fraudulent, misleading, or intentionally false statements to obtain medical certificate

You commit an offence if you do any of these things:

You make or cause someone to make a false statement to get a medical certificate under Part 2A. This includes statements that are fraudulent, misleading, or intentionally false.

You make a false entry in any document that shows you’re following the rules of your medical certificate under Part 2A. This could be in a logbook, record, form, or report. The false entry could be fraudulent, misleading, or intentionally untrue.

You copy or change a medical certificate issued under Part 2A for dishonest reasons.

You make a false statement during an investigation under section 27H, a review under section 27L, or an assessment under section 27M. This statement could be fraudulent, misleading, or intentionally untrue.

If you do any of these things and are found guilty, you could go to prison for up to 12 months or be fined up to $10,000.

46BFraudulent, misleading, or intentionally false statements to obtain medical certificate

  1. Every person commits an offence who makes or causes to be made—

  2. any fraudulent, misleading, or intentionally false statement for the purpose of obtaining a medical certificate under Part 2A; or
    1. any fraudulent, misleading, or intentionally false entry in any logbook, record, form, or report that is required to be kept, made, or used to show compliance with any conditions, restrictions, or endorsements placed on any medical certificate under Part 2A; or
      1. any reproduction or alteration for fraudulent purposes of any medical certificate issued under Part 2A; or
        1. any fraudulent, misleading, or intentionally false statement during an investigation under section 27H or a review under section 27L or an assessment under section 27M.
          1. Every person who commits an offence under subsection (1) is liable on conviction to imprisonment for a term not exceeding 12 months or to a fine not exceeding $10,000.
