29A: Rules relating to airspace

The Minister can make rules about airspace for different reasons. These reasons include making sure the civil aviation system is safe and secure, protecting national security, or for other public interests. The rules can classify, designate, or set special uses for airspace. They can also prohibit or restrict the use of airspace and things that affect the space where aircraft fly. This includes airspace used by New Zealand Defence Force aircraft or aircraft from other countries' militaries visiting New Zealand.

29ARules relating to airspace

  1. Without limiting the power conferred by section 28,—

  2. in the interests of safety or security within the civil aviation system; or
    1. in the interests of national security; or
      1. for any other reason in the public interest,—
        1. the Minister may make ordinary rules providing for the classification, designation, special use, prohibition, and the restriction of airspace and things affecting navigable airspace, including airspace used by aircraft used by the New Zealand Defence Force or a visiting force.

        2. Ordinary rules under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
