48: Applying for aviation document while disqualified

If a court has told you that you can’t get an aviation document, it’s against the law to try to get one anyway. If you do try to get one, any document you receive won’t be valid.

If you break this law, you can get in trouble. If you’re a person, you might have to go to jail for up to 6 months or pay a fine of up to $2,000. If you’re a company, you might have to pay a fine of up to $20,000.

The court can also stop you from getting or having an aviation document for up to 12 months if they think it’s necessary.

48Applying for aviation document while disqualified

  1. Every person commits an offence who applies for or obtains an aviation document while disqualified by an order of the court from obtaining such a document and any such document so obtained shall be of no effect.

  2. Every person who commits an offence against subsection (1) is liable on conviction,—

  3. in the case of an individual, to imprisonment for a term not exceeding 6 months or a fine not exceeding $2,000; or
    1. in the case of a body corporate, to a fine not exceeding $20,000,—
      1. and the court may order the person to be disqualified from holding or obtaining an aviation document for such period not exceeding 12 months as the court thinks fit.
