7: Requirement for aviation document

The rules made under this Act may say that you need an aviation document for many different things in civil aviation. This can include aircraft registered in New Zealand, pilots, flight crew, air traffic controllers, security personnel, and maintenance staff. It can also cover air services, airports, navigation providers, training organisations, and aircraft designers and manufacturers. The rules might even require documents for weather services, communication services, and other people or things involved in civil aviation.

The rules will explain what's needed for each type of aviation document, how to apply for it, and how long it can last. The Director can decide how long to issue a document for and what conditions to put on it, as long as they follow the rules.

If you don't agree with a decision made about your aviation document, you can appeal to the District Court.

7Requirement for aviation document

  1. Rules made under this Act may require that an aviation document shall be required by or in respect of all or any of the following:

  2. New Zealand registered aircraft:
    1. aircraft pilots:
      1. flight crew members:
        1. air traffic service personnel:
          1. aviation security service personnel:
            1. aircraft maintenance personnel:
              1. air services:
                1. air traffic services:
                  1. aerodromes and aerodrome operators:
                    1. navigation installation providers:
                      1. aviation training organisations:
                        1. aircraft design, manufacture, and maintenance organisations:
                          1. aeronautical procedures:
                            1. aviation security services:
                              1. aviation meteorological services:
                                1. aviation communications services:
                                  1. any persons, services, or things within any of the classes specified in paragraphs (a) to (p):
                                    1. such other persons, aircraft, aeronautical products, aviation related services, facilities, and equipment operated in support of the civil aviation system, or classes of such persons, aircraft, aeronautical products, aviation related services, facilities, and equipment operated in support of the civil aviation system, as may, in the interests of safety or security, be specified in the rules:
                                      1. any person who is an aviation examiner or medical examiner.
                                        1. The requirements, standards, and application procedure for each aviation document, and the maximum period for which each document may be issued, shall be prescribed by rules made under this Act.

                                        2. Subject to any rules made under this Act, an aviation document may be issued by the Director for such specified period and subject to such conditions as the Director considers appropriate in each particular case.

                                        3. Any person in respect of whom any decision is taken under this section may appeal against that decision to the District Court under section 66.
