34Procedure for making ordinary rules

  1. Before making any ordinary rule, the Minister must, as the Minister in each case considers appropriate,—

  2. publish a notice of his or her intention to make the rule; and
    1. consult—
      1. the persons, representative groups within the aviation industry or elsewhere, government departments, and Crown agencies; and
        1. the Environmental Protection Authority, established by section 7 of the Environmental Protection Authority Act 2011, about the contents of any rules that relate to the transportation of hazardous substances as defined in section 2(1) of the Hazardous Substances and New Organisms Act 1996.
