91ZLiability of carrier in respect of delay
A carrier is liable for damage caused by delay in the carriage of passengers.
Despite subsection (1), a carrier is not liable for damage caused by delay if the carrier proves that the delay—
- arose by reason of—
- meteorological conditions; or
- compliance with instructions, advice, or information given by an air traffic control service; or
- obedience to orders or directions given by a lawful authority; or
- meteorological conditions; or
- was made necessary by force majeure; or
- was necessary for the purpose of saving or attempting to save life.
