Gambling Act 2003

Gambling - Classes of gambling - Overview

21: Secretary may categorise gambling

You could also call this:

"The Government can choose which games are allowed or not allowed as gambling."

The Secretary can decide which games or types of gambling are included or excluded from a class of gambling. You need to know that the Secretary will make this decision if they think it helps achieve the purpose of the Gambling Act 2003 and if the level of risk associated with the game justifies the decision. The Secretary will do this by giving a notice, which is a type of secondary legislation, and you can learn more about publication requirements for secondary legislation by looking at Part 3 of the Legislation Act 2019. The Secretary's notice will explain their decision about which games or types of gambling are included or excluded. This decision is an important part of how the Secretary oversees gambling in New Zealand.
