312A: Duty to keep record of excluded persons

If you have a class 4 venue licence or casino operator’s licence, you must keep a record of people excluded from your venue. You need to record the person's name and date of birth if they provide it. You also need to record how they were excluded, which could be under section 309 or section 310.

You must record the date the exclusion order was issued and when it expires. If there are conditions for the person to re-enter the venue, you need to record those too.

If the Secretary asks, you must provide the person's initials and date of birth, and the other information you recorded, to the Secretary.

312ADuty to keep record of excluded persons

  1. Every holder of a class 4 venue licence or casino operator’s licence must,—

  2. in relation to each person excluded from the class 4 venue or casino venue (as the case may be), keep a record of—
    1. the person’s name and date of birth (if provided); and
      1. whether the person was excluded from the venue under section 309 or 310; and
        1. the date on which the exclusion order was issued and the date of its expiry; and
          1. any conditions imposed on the person’s re-entry to the venue; and
          2. provide the person's initials and date of birth and the information referred to in paragraph (a)(ii) to (iv) to the Secretary if requested to do so by the Secretary.
