16: Advertising overseas gambling prohibited

You cannot publish or arrange to publish an overseas gambling advertisement in New Zealand. This rule does not apply to publishing health messages about gambling or advertisements for services to prevent harm from gambling. You can also publish messages about preventing harm from gambling or advertisements for gambling equipment intended for buyers of that equipment.

If you break this rule, you commit an offence and can be fined up to $10,000. The Governor-General can restrict this rule if it is necessary for New Zealand to comply with its international trade obligations. An order under this section is secondary legislation, see Part 3 of the Legislation Act 2019 for publication requirements. You should know that an order is a type of law made by the government.

16Advertising overseas gambling prohibited

  1. A person must not publish or arrange to publish, in New Zealand, an overseas gambling advertisement.

  2. Subsection (1) does not apply to publishing or arranging to publish—

  3. a health message concerning gambling; or
    1. an advertisement for services to prevent, minimise, or treat harm; or
      1. a message about preventing, minimising, or treating harm; or
        1. an advertisement for gambling equipment intended for distribution only to buyers of gambling equipment; or
          1. an advertisement in which the publicising or promotion of gambling or a gambling operator is incidental to the purpose of the advertisement.
            1. A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine not exceeding $10,000.

            2. The Governor-General may, by Order in Council, restrict the application of this section, if satisfied that an order is necessary to enable New Zealand to comply with its international obligations relating to trade in services that are or will become binding on New Zealand.

            3. An order under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
