The Gambling Commission has many jobs to do. You can think of the Commission like a group of people who help make sure gambling happens fairly and safely in New Zealand. They look at applications for casino licences and decide whether to grant them. They also consider whether to renew or cancel these licences.

The Commission makes decisions about who can own a casino licence and under what conditions. They can add or remove conditions from a licence. You can find more information about some of these conditions in section 150 and section 187.

The Commission also deals with complaints and appeals about gambling decisions. They advise Ministers on gambling matters, like the problem gambling levy, which is explained in sections 317 to 325. The Commission must make their decisions on their own, without being influenced by the Minister or the Secretary.

224Functions of Gambling Commission

  1. The Gambling Commission’s functions are to—

  2. consider and decide whether to grant applications for casino operators’ licences:
    1. consider and decide whether to grant applications for the renewal of casino venue licences:
      1. consider and decide applications by the Secretary for orders to suspend or cancel a casino licence:
        1. consider and decide whether to approve—
          1. a mortgage, charge, or encumbrance of a casino licence; and
            1. the proposed transferee or alienee (and persons with a significant influence) of a casino licence resulting from the enforcement of a mortgage, charge, or encumbrance over a casino licence:
            2. consider and decide whether to grant applications for the approval of—
              1. casino venue agreements; and
                1. amendments to casino venue agreements:
                2. specify the conditions for inclusion in casino licences or vary or revoke the conditions of casino licences:
                  1. consider and decide appeals against decisions of the Secretary to specify, vary, or revoke, or to refuse to specify, vary, or revoke, the minimum operating standards included in a casino licence:
                    1. consider and decide appeals on—
                      1. unsuccessful applications for a licensed promoter’s licence; and
                        1. a decision by the Secretary to cancel, suspend, or refuse to renew a licensed promoter’s licence; and

                                  1. a decision by the Secretary not to grant a certificate of approval; and
                                    1. a decision by the Secretary to suspend or cancel a certificate of approval:

                                      1. consider and decide applications for temporary authority to operate a casino under section 187:
                                        1. deal with matters under section 156:
                                          1. consider and deal with complaints under section 81:
                                            1. facilitate a meeting and advise the responsible Ministers on the proposed problem gambling levy in accordance with the process established under sections 317 to 325:
                                              1. advise the Minister on matters relating to the performance of its functions or the administration of this Act, either at the Minister’s request or on its own initiative:
                                                1. exercise any other functions that are given to the Gambling Commission by this Act or by another enactment.
