The Secretary can make an order to suspend or cancel your certificate of approval if certain things happen. You might have given false information when you applied, or you might have been convicted of an offence against the Gambling Act 2003. The Secretary can also make an order if you have been convicted of another offence that shows you are not suitable to work in a casino, or if you have broken the rules in section 170.

The Secretary can suspend your certificate for up to six months or cancel it if they think it is necessary. They must be satisfied that one of the reasons for suspension or cancellation applies, and that it is desirable to make the order. When the Secretary makes an order, they must say when it starts.

The Secretary will send you a copy of the order and explain why they made it, and they will tell you about your right to appeal under section 171. If your certificate is suspended, the Secretary might revoke the suspension if the problems that led to the suspension are fixed and it is fair to do so. If your certificate is suspended or cancelled, you will not get a refund of the fees you paid.

The Secretary has the power to revoke a suspension if they think it is just to do so. This means they can lift the suspension if they are satisfied that the issues that led to the suspension have been resolved.

167Making and revoking order suspending or cancelling certificate of approval

  1. The grounds on which the Secretary may make an order suspending or cancelling a certificate of approval are as follows:

  2. that the certificate of approval was granted on the basis of information that was materially false or misleading:
    1. that the holder has been convicted, since applying for the certificate of approval, of an offence against this Act:
      1. that the holder has been convicted, since applying for the certificate of approval, of another offence reflecting on his or her suitability to be employed in a casino or engaged by a casino licence holder:
        1. that the holder has contravened section 170:
          1. that the conduct of the holder, since the issue of the certificate of approval, shows that he or she is not suitable to be employed in a casino or engaged by a casino licence holder.
            1. The Secretary may suspend for up to 6 months, or cancel, a certificate of approval if the Secretary is satisfied that—

            2. a ground in subsection (1) is established; and
              1. it is desirable to make an order.
                1. The Secretary must specify in the order the date that it takes effect.

                2. The Secretary must send a copy of the order and the reasons for it to the holder of the certificate of approval and notify the holder of the right of appeal under section 171.

                3. The Secretary may revoke the suspension of a certificate of approval if the Secretary is satisfied that the matters for which the suspension was imposed have been resolved (where possible) and that it would be just to revoke the suspension.

                4. A holder of a certificate of approval is not entitled to a refund of fees paid if the Secretary suspends or cancels the person’s certificate of approval.
