If you are a certain type of person, you cannot take part in class 4 gambling. You can only do it if you are doing your job and you must only do it as much as your job needs. These people include members of the Gambling Commission, the Secretary, gambling inspectors, and some employees of the Department.

If you are one of these people and you take part in class 4 gambling when you are not supposed to, you can get in trouble. If you are a member of the Gambling Commission or the Secretary, you can be fined up to $5,000. If you are a gambling inspector or a certain Department employee, you will be treated as if you broke the relevant minimum standards under section 17 of the Public Service Act 2020.

347Restriction on class 4 gambling by certain persons

  1. No person referred to in subsection (2) may participate in class 4 gambling—

  2. except in the performance of his or her duty; and
    1. only to the extent necessary for the performance of his or her duty.
      1. The persons are—

      2. a member of the Gambling Commission:
        1. the Secretary:
          1. a gambling inspector:
            1. an employee or class of employee of the Department specified by the Secretary.
              1. A person who fails to comply with this section,—

              2. in the case of a person specified in subsection (2)(a) or (b), commits an offence and is liable on conviction to a fine not exceeding $5,000; and
                1. in the case of a person specified in subsection (2)(c) or (d), must be treated as having breached the relevant minimum standards (if any) under section 17 of the Public Service Act 2020.
