142X: Person involved in breach liable to penalty

If you are involved in breaking employment laws, you might have to pay a penalty. This applies in two situations:

  1. You are involved in the breach as explained in section 142W of this law.
  2. The law says there is a penalty for that specific breach.

Only a Labour Inspector can ask for a penalty to be given to someone who was involved in breaking the law. This means you can’t be penalised unless a Labour Inspector decides to take action.

142XPerson involved in breach liable to penalty

  1. A person involved in a breach is liable to a penalty under this Act if—

  2. the person is involved in the breach within the meaning of section 142W; and
    1. this Act provides a penalty for the breach.
      1. An application for a penalty against a person involved in a breach may be made only by a Labour Inspector.
