243: Enforcement of existing collective employment contracts

“Old group work agreements still count and can be used in labour disputes”

If you had a collective employment contract under the old Employment Contracts Act 1991, and it was still active when the new Employment Relations Act 2000 started, your contract will keep working. You can still use it, and if you need to, you can ask the Employment Relations Authority or the Employment Court to make sure it’s followed.

Remember, though, that there are some special rules about this in sections 244 to 246 of the new Act. These rules might change how your old contract works in some ways.

243Enforcement of existing collective employment contracts

  1. Every collective employment contract within the meaning of the Employment Contracts Act 1991 that is in force immediately before the commencement of this Act continues in force according to its tenor and is enforceable in the Authority or the court.

  2. This section is subject to sections 244 to 246.
