242: Enforcement of existing individual employment contracts

If you had an individual employment contract under the old Employment Contracts Act 1991, it’s still valid when the new Employment Relations Act 2000 starts. Your old contract will keep working the same way it did before. If there are any problems with your old contract, you can still take it to the Employment Relations Authority or the court to sort things out.

It’s important to know that Part 6 of the new Employment Relations Act 2000 doesn’t apply to these old contracts. This means some of the new rules about how employment agreements work won’t affect your old contract.

242Enforcement of existing individual employment contracts

  1. Every individual employment contract within the meaning of the Employment Contracts Act 1991 that is in force immediately before the commencement of this Act continues in force according to its tenor and is enforceable in the Authority or the court.

  2. Part 6 does not apply in relation to any individual employment contract to which subsection (1) applies.
