237D: Reviews of decisions of Registrars concerning fees

If you disagree with a decision made by a Registrar of the court about fees, you can ask a Judge to review it. This is part of section 237B(1) of the law. You need to ask for this review within 20 working days after you’re told about the decision. If you need more time, you can ask the Judge, even after the 20 days have passed.

You don’t have to make your request in a formal way. The Judge will look at the whole matter again, usually just by reading the papers about it. But the Judge might decide to do it differently. After reviewing, the Judge can keep the Registrar’s decision the same, change it a bit, or completely change it.

You don’t have to pay anything to ask for this review.

237DReviews of decisions of Registrars concerning fees

  1. A person who disagrees with a decision of a Registrar of the court under regulations made under section 237B(1) may apply to a Judge for a review of that decision.

  2. The application must be made within—

  3. 20 working days after the date on which the applicant is notified of the decision; or
    1. any further time that the Judge allows on application, which may be made either before or after the expiry of that period.
      1. The application may be made informally.

      2. A review is—

      3. conducted by way of rehearing of the matter in respect of which the Registrar of the court made the decision; and
        1. dealt with on the papers, unless the Judge directs otherwise.
          1. The Judge may confirm, modify, or reverse the decision of the Registrar of the court.

          2. No fee is payable on the application.
