An infringement offence can be three things:

  2. If you break any other parts of this law that are listed as infringement offences in the regulations.

  3. If you’re an employer and you don’t do what you’re told to do under section 229(1)(d) within the time given in section 229(2A).

235AInterpretation

  1. In sections 235B to 235F,

    infringement fee in relation to an infringement offence, means the infringement fee for the offence specified in section 235E

      infringement offence means—

      1. a failure by an employer to comply with the requirements of section 64(1) or (2) or 130(1) of this Act or section 81(2) of the Holidays Act 2003:
        1. breaches of this Act that are prescribed by regulations as infringement offences:
          1. a failure by an employer to comply with a requirement made under section 229(1)(d) within the time period required by section 229(2A).
