Employment Relations Act 2000

Strikes and lockouts - Rights of union in relation to specified pay deductions

95E: Union may request information about application or calculation of specified pay deduction

You could also call this:

"Your union can ask your employer to explain pay deductions"

If you think your employer has incorrectly taken money from your pay, you can ask for help from your union. Your union can ask your employer to provide information about how they worked out the amount of money to take from your pay, as stated in section 95A. Your union must ask for this information in writing and do it as soon as possible after the pay day when the money was first taken.

When your union asks for this information, they must follow some rules. They must put their request in writing and they must make the request soon after the pay day when the deduction was first made. This means you cannot ask your employer directly for this information, only your union can do this on your behalf.

If you are part of a union and you think your employer has made a mistake with your pay, your union can help you by asking for more information. You cannot ask for this information yourself, it has to be your union that asks. Your union will ask your employer to explain how they worked out the amount of money to take from your pay.
