This part of the law only applies to certain types of councils called unitary authorities. These are councils that manage a district with one or more local board areas. These local board areas must be set up by an official order from the government. You can find out more about how these areas are set up in section 25.

It’s important to know that this part of the law doesn’t apply to the Auckland Council. The Auckland Council was set up by a different law called the Local Government (Auckland Council) Act 2009. You can read about how the Auckland Council was created in section 6 of that Act. This part also doesn’t apply to any of the local boards that are part of the Auckland Council.

48AApplication

  1. This subpart applies only to a unitary authority for a district that includes 1 or more local board areas established by Order in Council under section 25.

  2. Nothing in this subpart applies to the Auckland Council established under section 6 of the Local Government (Auckland Council) Act 2009 or to any local board of that council.
