261F: Effect of change to, or expiry of, material incorporated by reference

When a rule refers to other material, sometimes that material can change or stop being valid. This section explains what happens in those cases.

If the material that a rule refers to is changed or replaced, the new version only becomes part of the rule if the rule is updated to say so.

If the material that a rule refers to expires, is cancelled, or stops being valid, it only stops being part of the rule if the rule is updated to say so.

These rules make sure that changes to outside material don’t automatically change the rules without you knowing about it. The rules have to be deliberately updated to include any changes or to remove material that’s no longer valid.

261FEffect of change to, or expiry of, material incorporated by reference

  1. This section applies to—

  2. an amendment to, or a replacement of, material incorporated by reference in a rule:
    1. material incorporated by reference in a rule if the material expires, is revoked, or ceases to have effect.
      1. The amendment or replacement has legal effect as part of the rule only if the rule is varied to state that the amendment or replacement has that effect.

      2. The material described in subsection (1)(b) ceases to have legal effect as part of the rule only if the rule is varied to state that the material ceases to have effect.
