Local Government Act 2002

Regulatory, enforcement, and coercive powers of local authorities - Powers of local authorities to make bylaws - General provisions applying to bylaws made by a local authority

151: General provisions applying to bylaws made under this Act

You could also call this:

“Rules for making local laws about things like permits and fees”

This section applies to bylaws made under the Local Government Act 2002 or the Maritime Transport Act 1994.

You can make a bylaw that says things need to be done in a certain way or by a certain time. The local authority or someone mentioned in the bylaw can decide these details.

A bylaw can let the local authority make decisions about regulating, controlling, or prohibiting things. They can make these decisions for all cases, for specific types of cases, or for individual situations.

You can include rules in a bylaw about:

  • Giving licences to people or for property
  • Charging fair fees for licences
  • Getting back money the local authority spent on activities that needed a licence under the bylaw
