260: Amendment of Schedule 2 by Order in Council

If a local authority is abolished, its name is changed, or a new one is created, this section applies. You can find the local authorities in Part 1 or Part 2 of Schedule 2. The Governor-General can make changes to Schedule 2 by Order in Council.

The Governor-General may make amendments to Schedule 2 to reflect the changes to local authorities. This can include adding a new local authority's name and describing its district or region.

An Order in Council under this section can be combined with another Order in Council made under section 25, or any other matter, under this or any other Act. An order under this section is secondary legislation, and you can find out more about publication requirements in Part 3 of the Legislation Act 2019.

260Amendment of Schedule 2 by Order in Council

  1. This section applies if—

  2. a local authority named or specified in Part 1 or Part 2 of Schedule 2 is abolished, its name is altered, or a new local authority is created; or
    1. a district or region of a local authority described in Part 1 or Part 2 of Schedule 2 is altered; or
      1. the name of a district or region of a local authority described in Part 1 or Part 2 of Schedule 2 is altered under section 11(2) of the New Zealand Geographic Board (Ngā Pou Taunaha o Aotearoa) Act 2008.

        1. The Governor-General may, by Order in Council, make any amendments to Schedule 2 that may be necessary to give effect to the abolition or alteration, or may include the name of the new local authority and a description of its district or region in Schedule 2.

        2. Without limiting subsection (2), an Order in Council under that subsection may be combined with an Order in Council made under section 25, or any other matter, under this or any other Act.

        3. An order under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
