260: Amendment of Schedule 2 by Order in Council

This section applies when certain changes happen to local authorities, their districts, or regions. These changes can include:

  • A local authority listed in Part 1 or Part 2 of Schedule 2 is abolished, has its name changed, or a new one is created.
  • The area of a district or region of a local authority described in Part 1 or Part 2 of Schedule 2 is changed.
  • The name of a district or region of a local authority described in Part 1 or Part 2 of Schedule 2 is changed under section 11(2) of the New Zealand Geographic Board (Ngā Pou Taunaha o Aotearoa) Act 2008.

When these changes happen, the Governor-General can make an Order in Council to update Schedule 2. This order can make any necessary changes to reflect the abolition, alteration, or addition of a local authority, including its name and the description of its district or region.

The Order in Council can be combined with other orders made under section 25 or any other matters under this or other Acts.

An order made under this section is considered secondary legislation. This means it must follow the publication requirements set out in Part 3 of the Legislation Act 2019.

260Amendment of Schedule 2 by Order in Council

  1. This section applies if—

  2. a local authority named or specified in Part 1 or Part 2 of Schedule 2 is abolished, its name is altered, or a new local authority is created; or
    1. a district or region of a local authority described in Part 1 or Part 2 of Schedule 2 is altered; or
      1. the name of a district or region of a local authority described in Part 1 or Part 2 of Schedule 2 is altered under section 11(2) of the New Zealand Geographic Board (Ngā Pou Taunaha o Aotearoa) Act 2008.
        1. The Governor-General may, by Order in Council, make any amendments to Schedule 2 that may be necessary to give effect to the abolition or alteration, or may include the name of the new local authority and a description of its district or region in Schedule 2.

        2. Without limiting subsection (2), an Order in Council under that subsection may be combined with an Order in Council made under section 25, or any other matter, under this or any other Act.

        3. An order under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
