Local Government Act 2002

Regulations, other Orders in Council, and rules - Incorporation by reference

261D: Incorporation of documents by reference in rules

You could also call this:

“Rules can use information from other documents to help explain things”

When rules are made under section 261B, they can include information from other documents. These documents can be:

  • Standards, requirements, or recommended practices from international or national organisations
  • Standards, requirements, or recommended practices from any country or jurisdiction
  • Any other written material about technical matters that is too big or impractical to put in the rule itself

You can include all or part of these documents in the rule. You can also change or add to the information from these documents when you include it in the rule.

When you include information from these documents in a rule, it becomes part of the rule and has the same legal power as the rest of the rule.
