283: Annual reports

If you’re part of a local authority, you need to know about annual reports. If your local authority has made a report under section 223D of the Local Government Act 1974, you must also make an annual report under section 223E of that Act. This applies even if the report was made before this new law came into effect. You need to follow the rules in Part 7A of the old Act when making this annual report.

It’s important to know that sections 98 and 99 of the new law don’t apply when you’re making the annual report under section 223E of the old Act.

If you’re part of the Chatham Islands Council, you need to follow slightly different rules. Instead of using the sections mentioned above, you should use section 10 and section 11 of the Chatham Islands Council Act 1995. You also need to follow Part 7A of the Local Government Act 1974 when making your annual report.

283Annual reports

  1. If a local authority has prepared and adopted a report under section 223D of the Local Government Act 1974 for any year, whether before or after the commencement of this section, the local authority must prepare an annual report under section 223E of that Act in respect of that year, and that section and Part 7A of that Act apply to that annual report as if they had not been repealed.

  2. For the avoidance of doubt, sections 98 and 99 do not apply to the preparation and adoption, in accordance with subsection (1), of a report under section 223E of the Local Government Act 1974.

  3. This section applies to the Chatham Islands Council—

  4. as if, in subsection (1), for the words section 223D of the Local Government Act 1974, there were substituted the words section 10 of the Chatham Islands Council Act 1995; and
    1. as if, in subsection (1), for the expression section 223E, there were substituted the expression section 11; and
      1. as if, in subsection (1), for the words Part 7A of that Act, there were substituted the words Part 7A of the Local Government Act 1974; and
        1. as if, in subsection (2), for the words section 223E of the Local Government Act 1974 there were substituted the words section 11 of the Chatham Islands Council Act 1995.
