236: Penalty for acting without warrant

You could also call this:

“You can get in trouble for pretending to have permission to act for the local council when you don't”

You commit an offence if you pretend to have a warrant under section 174 when you don’t actually have one. This also applies if you continue to use a warrant after you are no longer an officer of the local authority or after your authority to act for them has ended.

If you do any of these things, you can be convicted and punished as set out in section 242(2) of this law.

236Penalty for acting without warrant

  1. Every person commits an offence and is liable on conviction to the penalty set out in section 242(2) who—

  2. does not have a warrant of the kind referred to in section 174, but represents himself or herself to be the holder of a warrant under that section; or
    1. acts under a warrant after the termination, as the case may be, of—
      1. his or her appointment as an officer of the local authority; or
        1. his or her authority to act on behalf of the local authority.
