Illustration for Local Government Act 2002

The Minister can postpone the next general election for a local authority when they appoint a Commission. This can happen at the same time as appointing the Commission under section 258F, or at any time while the Commission is doing the local authority's work. You need to know the Commission's term must extend more than 120 days beyond the election date, which is determined under section 10 of the Local Electoral Act 2001. If the Minister postpones the election, they must give public notice and call a new general election before the Commission's term ends, with notice in the Gazette and public notice of the election.

The Minister must give notice of the election date, which must be no later than 7 days before the Commission's term ends. If section 258J applies, the notice must include a statement about the Minister's decision. The Local Electoral Act 2001 applies to the election, but with some changes, and the electoral officer must give notice of the election under section 52 of the Local Electoral Act 2001. This notice must be given no later than 7 days after the Minister's notice, and must include a statement about the Minister's decision if section 258J applies. The Local Electoral Act 2001 has rules for the election.
