Local Government Act 2002

Planning, decision-making, and accountability - Planning and decision-making - Consultation

87: Other use of special consultative procedure

You could also call this:

“When local councils ask for your opinion on big decisions”

You need to know about when and how a local authority uses the special consultative procedure. This procedure is used in two situations:

  1. When the law says it must be used, but not in cases covered by section 86 or 93A.

  2. When a local authority chooses to use it.

When using this procedure, the local authority needs to provide a statement of proposal. This statement is different depending on what’s being proposed:

  1. If it’s a plan, policy, or similar document, they need to provide a draft of it.

  2. For any other proposal, they need to give a detailed statement about it.

When it’s not a plan or policy, the detailed statement must include:

  1. The reasons for the proposal.

  2. An analysis of the reasonable options, including the proposal itself. This analysis is identified under section 77(1).

  3. Any other information the local authority thinks is important.

This helps you understand what information you can expect when a local authority is using the special consultative procedure.
